Our commitment

Cerca respects the intellectual property rights of others and expects users to do the same. It is our policy to respond to notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act (DMCA).

Reporting copyright infringement

If you believe that content on Cerca infringes your copyright, please send a written notice to our designated Copyright Agent with the following information:

Required information for a DMCA notice

1. A physical or electronic signature of the copyright owner or authorized representative. 2. Identification of the copyrighted work claimed to have been infringed. 3. Identification of the material that is claimed to be infringing, with enough detail for us to locate it. 4. Your contact information (name, address, phone number, and email). 5. A statement that you have a good-faith belief that use of the material is not authorized by the copyright owner, its agent, or the law. 6. A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf.

Email: dmca@app-cerca.com We aim to respond to valid DMCA notices within 5 business days of receipt. Upon confirming a valid notice, we will take appropriate action — which may include removing or disabling access to the allegedly infringing content and notifying the responsible user.

Counter-notification

If you believe your content was removed in error, you may submit a counter-notification to dmca@app-cerca.com. A legally valid counter-notification must include: 1. Your physical or electronic signature. 2. Identification of the removed content and its location before removal. 3. A statement under penalty of perjury that you have a good-faith belief the material was removed by mistake or misidentification. 4. Your name, address, and phone number. 5. A statement consenting to the jurisdiction of the federal district court for the judicial district where your address is located — or, if you are outside the United States, any judicial district in which Cerca may be found — and that you will accept service of process from the person who submitted the original DMCA notice. We will forward valid counter-notifications to the original complainant. If the complainant does not file a court action within 10–14 business days, we may restore the removed content.

Repeat infringers

Cerca will terminate accounts of users who are found to be repeat infringers of intellectual property rights.
